Terms of Service
These Terms of Service ("Terms") govern your access to and use of DRVR's mobile applications, website, and related services (collectively, the "Services"), operated by Hybrid Arc Inc. ("DRVR", "we", "us", or "our"). By creating an account or using the Services you agree to these Terms.
1. Eligibility
You must be at least 18 years of age and capable of forming a binding contract to use DRVR. Drivers and Circle partners must additionally meet all licensing, insurance, and verification requirements of the jurisdictions in which they operate.
2. Account & Roles
DRVR supports four roles: Rider, Driver, Base Administrator, and Circle Partner. You agree to provide accurate information, keep your credentials confidential, and notify us immediately of any unauthorized use.
3. The Service
DRVR is a private network that connects passengers with independent professional chauffeurs and authorized livery operators. DRVR is a technology platform; we do not own vehicles, employ drivers, or provide transportation services directly. Drivers are independent contractors of their respective licensed bases and operate under their own authority.
4. Pricing & Payment
- Riders pay the fare quoted in the app at the time of booking. Optional gratuity is added at the rider's discretion.
- Drivers retain the full fare paid by the rider. Drivers are responsible for their applicable network/base contributions and any optional add-on services they elect (e.g. partner referral payouts).
- Circle Partners may earn commissions on referred trips, paid out via Stripe Connect according to their partnership agreement.
- All payments are processed by Stripe. Failed payments may result in account suspension.
5. SMS Messaging
By providing your mobile phone number, you consent to receive transactional SMS messages from DRVR related to your account and trips, including booking confirmations, driver assignments, arrival alerts, trip status, and security notifications.
Message frequency: recurring; varies based on activity. Message and data rates may apply.
Reply STOP to opt out at any time. Reply HELP or email contact@drvr.limo for assistance. Carriers are not liable for delayed or undelivered messages. We do not share opt-in or consent data with third parties for marketing purposes. See our Privacy Policy for full details.
6. User Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of any local, state, or federal law.
- Harass, threaten, or harm other users, drivers, or DRVR personnel.
- Damage vehicles or interfere with a driver's ability to operate safely.
- Attempt to reverse-engineer, scrape, or interfere with the Services.
- Misrepresent your identity or impersonate another person.
DRVR reserves the right to suspend or terminate any account that violates these Terms.
7. Cancellations & No-Shows
Riders may cancel a trip free of charge within a reasonable window after booking. Late cancellations or no-shows may incur a fee. Drivers should not cancel accepted trips except in emergencies.
8. Driver & Partner Obligations
Drivers and Circle partners agree to maintain all required licenses, insurance, vehicle inspections, and base affiliations. DRVR may, at any time, request documentation and may suspend any driver or partner whose status is in question.
9. Disclaimers
The Services are provided "AS IS" without warranties of any kind. DRVR does not guarantee continuous availability, on-time arrival, or any specific outcome of a trip. To the fullest extent permitted by law, DRVR disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, DRVR's total liability arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid DRVR in the six (6) months preceding the claim, or (b) one hundred US dollars ($100). DRVR is not liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless DRVR and Hybrid Arc Inc., their officers, directors, employees, and agents from any claims, losses, or expenses arising out of your use of the Services or your breach of these Terms.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms shall be resolved by binding arbitration in Delaware, except that either party may bring an individual claim in small-claims court.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of the Services after changes take effect constitutes acceptance.
